Approval must be gained under the NSW Heritage Act, 1977 when making changes to a heritage place listed on the State Heritage Register or covered by an interim heritage order. Or when excavating any land in NSW where you might disturb an archaeological relic.
There are various forms of approval which are each outlined below. Sydney Harbour Foreshore Authority staff are able to assist in determining which type of approval may be required and can be contacted by using the contact us form.
To carry out work
Approval under Section 60 may be required to carry out activities to an item listed on the State Heritage register (SHR) or to which an interim heritage order (IHO) applies. Approval must gained from the Heritage Council when making changes to these heritage items. A Foreshore Authority – S60 Heritage Application Form will be required at the time of application.
If the works are minor in nature they may be exempt from approval under Section 60. These works are outlined within the Heritage Office Publication Standard Exemptions for Works Requiring Heritage Council Approval. A Foreshore Authority – S.57 Heritage Exemptions Notification is required to
Archaeology
Application is required if you are going to disturb or excavate any land that is likely to contain archaeological remains. If the site is listed on the NSW State Heritage Register (SHR) a Foreshore Authority – S60 Heritage Application Form (link to form) is required. In instances where the site is not listed on the SHR a Foreshore Authority – S140 Application Form is required. An excavation permit may not be required where works are only minor in nature, and will have minimal impact on the heritage significance of the place. In these instances an Exception Application Form will be required.
